Emily Garson, Kristine Nesthus facing sanctions for Perjury, Obstruction of Justice in Racketeering Lawsuit
In California Coalition’s Motion to Strike portions of the San Diego Superior Court’s Motion to Dismiss, California Coalition identifies criminal activity of San Diego Court Counsel Ms. Kritine P. Nesthus, and Assistant City Attorney Ms. Emily Garson. California Coalition requests to strike the declarations and take evidence from the Superior Court’s witnesses on their alleged obstruction of justice and perjury committed in the ongoing lawsuit. From the Motion:
Defendants have attempted to introduce immaterial, impertinent, controversial, scandalous, and inadmissible evidence in support of a motion that cannot weigh evidence. They have submitted a perjurous declaration and foundationless, incomplete, and potentially fraudulent documents—via a request for judicial notice. They have misunderstood and misrepresented
“capacity” and “standing” under both state and federal law. The have requested the wrong relief under the wrong authority. They have refused Plaintiff’s efforts toward informal resolution by withdrawal of the errant pleadings and exhibits, and refused stipulations to resolve pleading matters which are properly and regularly resolved by leave to amend, forcing unnecessary pleading in opposition.
